REGULATIONS OF THE ONLINE STORE

HSNF LIMITED

§1

General provisions

  1. These Regulations define the rules for the sale of Products by HSNF via the Online Store, are addressed to Consumers and specify the rules and procedure for concluding Sales Agreements with Customers remotely via the Online Store.
  2. The provisions of these Regulations also apply to a natural person concluding a contract directly related to his/her business activity, when the content of this contract shows that it does not have a professional character for this person, resulting in particular from the subject of his/her business activity, made available under the provisions of on the Central Registration and Information on Economic Activity.
  3. Contact with the Online Store is possible via e-mail at the following e-mail address: info@mylee.pl.
  4. The Online Store responds to messages sent via e-mail within 5 business days.
  5. Before registering and placing an Order, the Customer is obliged to read these Regulations.
  6. By concluding a Sales Agreement with HSNF, the Customer accepts the conditions set out in these Regulations.
  7. To use the Online Store, you need an end device with access to the Internet and a web browser, as well as an active e-mail account and cookies enabled.

§ 2 Definitions

  1. Online Store - a store operating under the domain www.mylee.pl, which sells Products offered by HSNF.
  2. HSNF - HSNF LTD with its registered office in Great Britain, address: Finsgate, 5-7 Cranwood Street, London EC1V 9EE, Great Britain, mailing address: 139-141 Pembroke Rd, London N10 2JE, Great Britain, entered into the British Register of Companies under number 06945009, e-mail address: info@mylee.pl (hereinafter referred to as: HSNF ).
  3. Consumer - a Customer who concludes a Sales Agreement with HSNF for purposes not directly related to the business or professional activity conducted or a natural person concluding an agreement directly related to his or her business activity, when the content of this agreement shows that it is not of a professional nature for this person, resulting in particular from the subject of its business activity, made available on the basis of the provisions on the Central Registration and Information on Economic Activity.
  4. Customer - a natural person who is over 13 years of age, however, in the case of persons who are under 18 years of age - the consent of their statutory representative, a legal person or an organizational unit without legal personality but having legal capacity, using the Store is required to conclude a contract. Online, in particular when making a purchase in the Online Store.
  5. Product – a movable item or service offered by HSNF for sale in the Online Store.
  6. Regulations - these Regulations of the Online Store.
  7. Sales Agreement - Product sales agreement concluded by the Customer with HSNF.
  8. Order - the Customer's declaration of will submitted electronically, aimed directly at concluding a Sales Agreement for the Product or Products with HSNF.
  9. Account - the Customer's account in the Online Store, which collects data provided by the Customer and information about Orders and Reservations placed by him in the Store.
  10. Registration Form - a form available in the Online Store, enabling the creation of an Account.
  11. Order Form - an interactive form available in the Online Store enabling placing an Order, in particular by adding Products to the Cart and specifying the terms of the Sales Agreement, including the method of delivery and payment.
  12. Cart - an element of the Online Store software in which the Products selected by the Customer for purchase are visible, and it is also possible to determine and modify the Order data, in particular the quantity of products.

§ 3 Account in the Online Store

  1. HSNF provides electronic services to enable Customers to set up and use a Customer Account on the Online Store website.
  2. Creating a Customer Account allows Customers to use all available functionalities of the Online Store, including full access to and management of Order history, a quick and convenient process of placing subsequent Orders, the ability to use a clipboard to facilitate placing subsequent Orders, adding Product reviews, registering returns and complaints. .
  3. In order to create an individual Account in the Online Store, it is necessary for the Customer to complete the Registration Form by providing an e-mail address and username.
  4. Completing the Registration Form is voluntary, but its completion is necessary to create an Account and place Orders through it.
  5. After the Customer completes and approves the Registration Form, he or she receives a message from HSNF to the provided e-mail address confirming the creation of the Account and for the final Account Registration, the Customer is obliged to click on the received Account activation link.
  6. Logging in to the Account is done by providing the login established in the Registration Form and a randomly generated password sent to the e-mail address provided in the Registration Form or a password changed by the Customer on his/her Customer Account.
  7. After creating the Account, the Customer has the opportunity to complete his/her detailed data, including: name and surname, displayed name of the Customer, optionally telephone number, billing address, delivery address if the address is different from the billing address, optionally Tax Identification Number.
  8. The Customer may edit his/her data provided in the Customer Account at any time and, without giving a reason and without incurring any fees, delete the Account by sending an appropriate request to HSNF, in particular via e-mail or in writing to the HSNF address.
  9. If any activities undertaken by the Customer within the Online Store violate generally applicable provisions of law, laws or personal rights of third parties or the provisions of the Regulations, HSNF is entitled to block the Customer's Account, of which the Customer will be notified to the e-mail address provided when registering the Account.

§ 4 Orders

  1. It is possible for the Customer to place an Order for Products offered by HSNF in the Online Store:
  2. using an Account in the Online Store;
  3. using the Order Form, by providing the data necessary to complete the Order without the need to register an Account in the Online Store.
  4. In order to place an Order in accordance with section 1a, the Customer logs in to his/her Account in the Online Store, selects the Product that is the subject of the Order by adding it to the Cart, and then selects the method of Product delivery and the delivery address if it is different from that indicated on the Customer's Account and confirms the selection by clicking the "Go to" button. to checkout” and confirms the Order.
  5. In order to place an Order in accordance with section 1b, the Customer selects the Product that is the subject of the Order by adding it to the Cart and confirms the selection by clicking the "Go to checkout" button, and then completes the Order Form by indicating the selected Product, Customer data, method of Product collection/delivery, delivery address, payment method, invoice data and confirms the Order.
  6. After placing an online order, the Customer can check the order status by logging into his Customer Account. An order confirmation email is also sent, but HSNF is not responsible if the email is identified by any webmail service as junk mail and undelivered/misdelivered.
  7. HSNF will begin processing the Order after receiving payment from the Customer in accordance with the selected payment method.
  8. The prices given in the Online Store are given in Polish zloty and are gross prices (including VAT).
  9. Product prices given in the Online Store do not include delivery costs, which, depending on the Product ordered, will be provided during the Order placement process when choosing the Product delivery method.
  10. Promotions in the Online Store cannot be combined with other promotions.
  11. If, when placing an order, the Customer indicates that he wants to receive an electronic invoice, it will be sent to the e-mail address provided by him.
  12. A Customer who has a Customer Account also has the option of downloading a VAT invoice from his/her account in an electronic version.
  13. If the Order has not been sent, the Customer has the option of changing the delivery address; if the Order has been sent, changing the delivery address is only possible via the website of the courier company delivering the Order, if such functionality is available. Change of address is not guaranteed when the Order is with the courier.
  14. In some cases, Orders may be canceled by the HSNF system due to: problems with processing payment information, unavailability of Products, inability to deliver to the provided address, technical error on the website, Customer's request for cancellation, duplicate Orders.
  15. The Customer may cancel the Order by sending a request to the e-mail address: info@mylee.pl, providing the order number. If the Order has already been shipped, HSNF will inform the customer of this fact.
  16. The cost of delivery of any Orders returned to HSNF as a result of the Customer not collecting them or providing an incorrect address is borne by the Customer.
  17. The cost of replacing Products from the Order which, due to HSNF's fault, were delivered inconsistently with the Order, shall be borne by HSNF.

§ 5 Promotional codes

  1. HSNF reserves the right to reject an Order if, in its opinion, the promotional code is invalid for the order placed.
  2. Promotional codes have no monetary value and cannot be exchanged for cash.
  3. Promotional codes cannot be used in conjunction with any other offers or promotions. Unless otherwise noted, promotional codes do not apply to discounted items, multiple purchase offers, or delivery fees. Offers do not apply to clearance or other discounted items.
  4. Promotional codes are single-use and you can use one Code for one Order.
  5. To redeem a Promotional Code, follow these steps:
  • place all Products to be purchased in your Shopping Cart and click on the Shopping Cart icon in the upper right corner of the HSNF website;
  • click the "view and edit" Order tab and then enter your promotional code in the "Enter discount code" field located in the "Discount code" section on the "Checkout" page. Select 'Apply Code' The page will be updated and the Promotional Code will be applied;
  • click "Go to checkout", then the customer will be redirected to the payment page.

§ 6

Product Delivery and Payment

  1. Delivery of the Products purchased by the Customer takes place only within the territory of the Republic of Poland by delivering the Products to the Customer's address provided when placing the Order.
  2. The logistics operator in Poland, acting on behalf of and for HSNF, is HSNF PL sp. z o. o. in Poznań, address: ul. Główna 6, 61-005 Poznań, entered into the Register of Entrepreneurs of the National Court Register kept by the District Court Poznań - Nowe Miasto i Wilda in Poznań, 8th Commercial Division of the National Court Register under the number 0000962706, share capital: PLN 5,000.00, REGON: 521566132, NIP: 7822908491.
  3. Products are shipped by HSNF on business days within 24 hours of receiving payment from the Customer.
  4. Products are delivered by DHL and Inpost within 1-2 business days.
  5. The deadlines indicated in section 3 and 4 are indicative deadlines, HSNF makes every effort to meet them, but at the same time stipulates that they may be extended for reasons beyond the control of HSNF.
  6. The Customer may use the payment method for the purchased Products using the website www.przelewy24.pl. Possible current payment methods are specified on the website www.przelewy24.pl .
  7. For security reasons, the Customer's name and billing address must match the credit/debit card used for payment. We reserve the right to cancel any Order that does not meet these criteria.

§ 7 Performance of the sales contract

  1. The conclusion of the Sales Agreement between the Customer and HSNF takes place after the Customer places an Order for the Products offered in the Online Store in accordance with § 4 of the Regulations.
  2. After placing the Order, HSNF immediately confirms its receipt and simultaneously accepts the Order for execution. Confirmation of receipt of the Order and its acceptance for execution takes place by HSNF sending the Customer an appropriate e-mail to the Customer's e-mail address provided when placing the Order. When the Customer receives the above e-mail, a Sales Agreement is concluded between the Customer and HSNF.

§ 8 Right to withdraw from the contract

  1. The consumer may withdraw from the Sales Agreement without giving any reason within 14 days. The deadline begins with the delivery of the Product to the Consumer.
  2. The Consumer may withdraw from the Agreement by submitting a declaration of withdrawal from the Agreement to HSNF. To meet the deadline for withdrawal from the Agreement, it is sufficient for the Consumer to send a statement before the deadline.
  3. The declaration may be sent by traditional mail or electronically by sending the declaration to the HSNF e-mail address.
  4. The declaration may also be submitted on the form, the template of which is attached as Annex 1 to these Regulations, but this is not obligatory.
  5. If the Consumer sends the declaration electronically, HSNF will immediately send the Consumer confirmation of receipt of the declaration of withdrawal from the Agreement to the e-mail address provided by the Consumer.
  6. In the event of withdrawal from a distance contract, the contract is deemed not to have been concluded.
  7. In the event of withdrawal from the Agreement, HSNF returns to the Consumer immediately, no later than within 14 days from the date of receipt of the Product, all payments made by him, including the costs of delivering the Product (except for additional costs resulting from the method of delivery chosen by the Consumer other than the cheapest standard method). delivery method offered by HSNF).
  8. The consumer returns the Products to the following address: Prologis Park I, ul. Poznańska 16B, 62 – 080 Sady n/Poznań immediately, but no later than within 30 days from the date on which the Consumer received the Product from HSNF.
  9. The consumer bears the direct costs of returning the goods.
  10. The consumer is responsible for any reduction in the value of the returned Products resulting from using them in a way that goes beyond what is necessary to establish the nature, characteristics and functioning of the Products.
  11. HSNF will refund the payment using the same payment methods that were used by the Consumer in the original transaction, unless the Consumer has expressly agreed to a different solution that will not involve any costs for him.

§ 9 Complaints

  1. HSNF is obliged to provide the Customer with Products without defects and is liable to the Customer if the Product sold has a physical or legal defect, in accordance with the principles set out in the Civil Code.
  2. If the Customer is an Entrepreneur other than that referred to in § 1 section 2 of the Regulations, the parties exclude liability under the warranty.
  3. HSNF is liable under the warranty for physical defects that existed at the time the danger passed to the Customer or resulted from a cause inherent in the Product sold at the same time, which were discovered within two years from the date of delivery of the Product to the Customer.
  4. The Customer has the right to complain about the Products based on warranty provisions.
  5. Complaints should be submitted in writing or electronically to the HSNF address provided in these Regulations, attaching proof of purchase of the Product or providing the Order number.
  6. The customer's complaint should include, among others: a concise description of the defect, the circumstances (including the date) of its occurrence, details of the Customer filing the complaint, and the Customer's request in connection with the defect.
  7. If, after receiving a complaint from the Customer, HSNF decides that it is necessary to deliver the Product in order to consider it, the Customer is obliged to deliver it to the following address: Prologis Park I, ul. Poznańska 16B, 62 – 080 Sady n/Poznań.
  8. HSNF will respond to the complaint immediately, no later than within 14 days, and if it does not do so within this period, it is considered that the Customer's request is justified.

§ 10 Extrajudicial methods of dealing with complaints and pursuing claims

  1. Detailed information on the possibility for the Consumer to use out-of-court methods of dealing with complaints and pursuing claims, as well as the rules of access to these procedures, are available at the offices and on the websites of district (municipal) consumer ombudsmen, social organizations whose statutory tasks include consumer protection, and Provincial Inspectorates of Inspections. Handlowa and on the website of the Office of Competition and Consumer Protection:
  2. The consumer has the following exemplary options for using out-of-court methods of dealing with complaints and pursuing claims:
  3. The consumer is entitled to apply to a permanent consumer arbitration court to resolve a dispute arising from the contract concluded with HSNF;
  4. The Consumer is entitled to apply to the provincial inspector of the Trade Inspection to initiate mediation proceedings regarding the amicable settlement of the dispute between the Consumer and HSNF;
  5. The consumer may obtain free assistance in resolving the dispute between him and HSNF, also using the free assistance of the district (municipal) consumer ombudsman or a social organization whose statutory tasks include consumer protection (including the Consumer Federation, the Association of Polish Consumers);
  6. The consumer can use the online ODR platform available at: http://ec.europa.eu/consumers/odr/.

§ 11 Personal data

  1. The administrator of Customers' personal data processed via the Online Store is HSNF.
  2. Customers' personal data processed by the administrator via the Online Store are processed for the following purposes:
  3. concluding and implementing Sales Agreements, settling them, considering complaints, answering Customers' questions, contacting Customers, issuing invoices and bills to them, registering individual Customer Accounts - processing in this respect is necessary for the implementation of contracts concluded with customers (Article .6(1b) GDPR);
  4. tax and accounting - processing in this respect is necessary to fulfill the legal obligation of the administrator (Article 6(1c) of the GDPR);
  5. debt collection and enforcement of claims, conducting court, arbitration and mediation proceedings or defending against possible claims - processing in this respect is necessary for the purposes of the legitimate interests pursued by the administrator (Article 6(1f) of the GDPR).
  6. Personal data will be stored for the period of performance of the contract, but no longer than the limitation period for claims arising therefrom and the period of necessity to fulfill the legal obligations imposed on the administrator. Personal data processed on the basis of the consent expressed by the person whose data is processed will be stored until the consent is withdrawn.
  7. An essential element of the Registration procedure and placing an Order is that the Customer provides his/her personal data, marked as obligatory, and the Customer's consent to the processing of his/her personal data provided during Registration and placing an Order. Providing personal data marked as obligatory is voluntary, but necessary for Registration, placing an Order, its implementation and service. Providing personal data not marked as obligatory is voluntary.
  8. The recipients of personal data, if necessary to perform the contract, may also be persons authorized by the administrator to process personal data: employees and collaborators; a company providing IT services to the administrator, an accounting company, a law firm, courier companies, HSNF PL sp. z o. o. as a logistics operator.
  9. The customer has the right to: withdraw consent to data processing, the right to access personal data, the right to request rectification of personal data, the right to request the deletion of personal data, the right to request restriction of the processing of personal data, the right to object to the processing of personal data, the right to transfer personal data; the right to lodge a complaint with the supervisory authority responsible for the protection of personal data.
  10. The above rights may be exercised by persons whose personal data are processed by sending a letter to the administrator's address.
  11. Personal data will be processed in an automated or partially automated manner. However, they will not be used to make decisions based solely on automated processing, including profiling.
  12. HSNF uses cookies on the website where the Online Store is operated. Detailed information about these files is included in the Privacy Policy available on the Online Store website.

§ 12 Final provisions

  1. The Product Sales Agreement may be concluded only in Polish.
  2. HSNF reserves the right to make changes to the Regulations for important reasons, i.e. changes in legal provisions, changes in payment and delivery methods - to the extent that these changes affect the implementation of the provisions of these Regulations. HSNF will inform the Customer about any change at least 7 days in advance.
  3. In matters not regulated in these Regulations, generally applicable provisions of Polish law shall apply, in particular: the Civil Code; Act on the provision of electronic services; Consumer Rights Act, Personal Data Protection Act.
